Our products are handcrafted food items produced in shared facilities.

  • Products may contain or come into contact with allergens including, but not limited to, milk, tree nuts, peanuts, soy, wheat, and other common allergens.
  • We do not guarantee that any product is allergen-free.
  • Ingredient information is provided where available but may not reflect cross-contact risks.

You are responsible for determining whether a product is appropriate for your consumption.

4. Product Nature and Variability

Due to the small-batch nature of our products, variations in flavor, texture, appearance, color, and finish may occur. Minor imperfections are not defects and are not grounds for refund or replacement.

5. Orders, Acceptance, and Availability

Placing an order constitutes an offer to purchase. We reserve the right to accept or decline any order for any reason. An order is not accepted until it has been confirmed by us.

All orders are subject to availability. We reserve the right to limit quantities, refuse or cancel orders, or discontinue products at any time.

6. Pricing, Billing, and Errors

Prices, discounts, promotions, taxes, shipping charges, and availability are subject to change without notice. In the event of a pricing, listing, inventory, shipping, or product information error, we reserve the right to correct the error, modify an order, or cancel an order, including after submission.

If an order is canceled after payment, a refund will be issued.

You agree to provide current, complete, and accurate billing, payment, and shipping information for all purchases.

7. Shipping, Perishability, and Risk of Loss

Our products are perishable and sensitive to heat and environmental conditions.

  • Shipping dates and transit times are estimates only.
  • We are not responsible for carrier delays or conditions outside our control.
  • Risk of loss transfers to the customer upon delivery of the order to the carrier.

Chocolate may be affected by temperature during transit, including melting, softening, or cosmetic changes such as bloom.

We offer a "Chocolate Safe Shipping" approach intended to reduce these risks; however, outcomes may vary based on transit conditions.

Shipping issues, damage claims, replacements, refunds, and delivery-related concerns are handled in accordance with our Shipping Policy and Returns & Refunds Policy, which are incorporated into these Terms by reference.

8. Returns and Refunds

Due to the perishable nature of our products, all sales are final except as provided in our Returns & Refunds Policy.

We do not accept physical returns of chocolate or other perishable food products.

9. Chargebacks and Payment Disputes

By placing an order, you agree to contact us directly to resolve any issue before initiating a chargeback.

Improper or fraudulent chargebacks may result in order refusal in the future and submission of evidence to payment processors disputing the claim.

10. Intellectual Property

All content on this website, including text, images, graphics, product names, branding, logos, design, and layout, is owned by or licensed to Blue Heron Holdings, LLC and may not be copied, reproduced, distributed, modified, displayed, or used without our prior written permission.

We are not responsible for third-party websites, services, content, policies, or practices.
